    The Verkhovna Rada Committee on Economic Development considered the conclusions of the Accounting Chamber on the AMCU report for 2024

    The Committee of the Verkhovna Rada of Ukraine on Economic Development considered the Report of the Accounting Chamber on the results of the analysis of the report of the Antimonopoly Committee of Ukraine for 2024 in the part that affects the implementation of the state budget.

    The person responsible for the control measure – member of the Accounting Chamber Hennadiy Plis –  noted that the AMCU report was submitted to the Verkhovna Rada within the time limits specified by law,  the information in it is generally presented properly. At the same time, a member of the Accounting Chamber emphasized that the AMCU report contains a number of shortcomings, including those that prevent an objective assessment of the activities of this body.

    Among other things:

    – only partially reflects information on the AMCU's participation in the formation and implementation of competition policy in 2024;

    – the report does not contain separate sections on the AMCU's assistance in the development of fair competition, a section on the AMCU's activities in the part that affects the execution of the state budget, on problematic issues in the Committee's activities, etc.;

    – full information on the status of the imposition and collection of fines, analysis of trends in this area is not provided.

    In addition, the economic effect of UAH 6.3 billion (out of UAH 8.8 billion) given in the AMCU report cannot be confirmed by the Accounting Chamber.

    «The total amount of unpaid fines under AMCU decisions as of December 31, 2024 is UAH 15.1 billion, of which UAH 8.1 billion are for decisions appealed in courts.  This is due to the automatic suspension of the execution of AMCU decisions in the event of their appeal. At the same time, the share of AMCU decisions recognized by the courts as invalid in whole or in part in 2020-2024 was from 0.1% to 3% of the total. To resolve the problem of collecting fines, a draft Law of Ukraine has already been developed, which provides that filing a lawsuit does not suspend the execution of the decision, and also introduces joint and several liability and legal succession.» — noted Hennadiy Plis.

    For his part, the Chairman of the Antimonopoly Committee Pavlo Kyrylenko, who also participated in the Committee meeting, commented on the reasons for certain shortcomings identified during the analysis of the AMCU report by the Accounting Chamber, and also reported on the measures the body is taking to eliminate them.

    Also during the meeting, the people's deputies drew attention to the importance of resolving the issue of  collecting fines, restoring state aid control, and the need for proper implementation of the localization legislation.

    Following the results of the meeting, the VRU Committee on Economic Development adopted two decisions:

    –   take the report of the Accounting Chamber into account;

    – take into account the recommendations provided by the Accounting Chamber based on the results of the analysis of the AMCU report.
