    Preparation and provision of opinions on draft laws related to the work of the Accounting Chamber. The procedure has been approved

    The Accounting Chamber has approved theProcedure for the preparation and submission of mandatory opinions on draft legislative acts concerning the status, independence, organization, powers and procedure for the activities of the Accounting Chamber and other issues related to its functioning (hereinafter –  Procedure).

    In accordance with the provisions of the Law of Ukraine “On the Accounting Chamber”, which fully entered into force on January 1, 2025, the institution will provide opinions on draft laws concerning the status, independence, organization, powers and procedure for the activities of the Accounting Chamber and other issues related to its functioning.

    These are draft laws that are registered with the Office of the Verkhovna Rada of Ukraine and are being prepared for consideration by the parliament in the first reading. The opinion of the Accounting Chamber is provided to the VRU Committee responsible for the draft law and directly to the initiator of the draft law, as well as for the information of the Chairman of the VRU and the VRU Committee on Budget Issues. The presence of such an opinion during the consideration of the draft law in the first reading is mandatory.

    Therefore, the adopted Procedure regulates the mechanisms for processing such a legislative act, providing proposals and comments on it, preparing a draft opinion on the draft law and its consideration.

    In particular, draft laws that require the opinion of the Accounting Chamber may be submitted to the institution officially. At the same time, the responsible department constantly examines the website of the Verkhovna Rada for new projects and, if detected, informs the Chairman and members of the Accounting Chamber, the head of the staff and, if necessary, the structural divisions of the Accounting Chamber.

    Within seven days after receiving or detecting such a document, a conclusion must be prepared regarding it, unless the Chairman of the Accounting Chamber sets other terms. If an opinion needs to be issued urgently, changes in the procedure for preparing a draft of such an opinion are determined separately by the Head of the Accounting Chamber.

    The preparation of draft opinions is entrusted to the Department of Legal Support of the Accounting Chamber, and members of the Accounting Chamber may provide their proposals and comments on draft laws. Also, the Department of Legal Support may involve structural units of the Accounting Chamber's staff as co-executors in the processing of draft laws and the formation of a position on them.

    Let us recall that according to the amendments to the Law of Ukraine On the Accounting Chamber» and some other legislative acts of Ukraine, in order to strengthen guarantees of independence, any draft law relating to the activities of the Accounting Chamber or its powers must receive an appropriate opinion from the institution.
