Implementation of recommendations in the field of economy, digital transformation, competition protection and state property management. Analysis for 2020-2024
Liability for violations of competition law has been strengthened, the National Informatization Program and the Strategy for Reforming Public Procurement until 2026 have been approved. These and other measures have been taken to implement the recommendations of the Accounting Chamber, provided during 2020-2024 to objects of control in the field of economy, digital transformation, protection of economic competition and management of state property.
The report on the results of the analysis of the implementation of these recommendations was adopted at the meeting on April 22. The person responsible for these control measures – member of the Accounting Chamber Hennadiy Plis.
During the analysis, the results of 22 control measures carried out by the Accounting Chamber in the specified period were analyzed. Based on their results, 207 recommendations were made. Of these, 172 (83.1 %) have currently been implemented. At the same time, the objects of control were the Ministry of Economy of Ukraine, the Ministry of Digital Transformation of Ukraine (hereinafter - the Ministry of Digital Transformation),the State Enterprise "DIYA" (hereinafter - the State Enterprise "DIYA"),the Antimonopoly Committee of Ukraine, the State Property Fund of Ukraine (hereinafter - the State Property Fund of Ukraine),the National Commission for State Regulation in the Sphere of Communications and Informatization (hereinafter - the NCCRI),the State Enterprise "Research and Production Agro-Combine "Puscha-Vodytsia" (hereinafter - the State Enterprise "Puscha-Vodytsia").
The majority of the recommendations provided concerned the improvement of organizational and administrative functions, the rest - regulation of regulatory and legal regulation of activities.
«Overall, the analysis demonstrated the importance of the impact of the Accounting Chamber's recommendations on changes in the areas of economic activity, digital transformation, protection of economic competition and management of state property. As a result of their implementation, four laws, five decisions of the Cabinet of Ministers of Ukraine, 18 other regulatory documents», – noted Hennadiy Plis.
In particular, the implementation of the recommendations of the Accounting Chamber in these areas contributed to:
- optimization of taxation of state property in the field of digitalization;
- strengthening of liability for violation of antitrust legislation due to the update of the relevant law on economic competition;
- improvement of legislation on state property management, in particular in the field of sanctions policy, 137 property rights to seized assets subject to sanctions legislation have been registered;
- adoption of the Law of Ukraine “On the National Informatization Program”, which regulates digital transformation at the state level;
- approval of the Strategy for Reforming the Public Procurement System for 2024-2026.
The Ministry of Economy of Ukraine and the Antimonopoly Committee of Ukraine have for the first time regulated, and the SPFU has improved, the methodology for annual reporting on the results of its activities.
Currently, according to the analysis, the highest rates of implementation of recommendations are in the State Enterprise "DIYA" and the National Commission for the Promotion of Information and Communication Technologies (100%) and the Ministry of Digital Economy (96%). The fewest recommendations were implemented by the State Enterprise "Pushcha-Vodytsia" (33.3 %).
Among the main reasons for non-implementation of the recommendations are circumstances related to the military aggression of the Russian Federation, changes in legislation that led to the loss of relevance of the recommendations, as well as the untimely adoption of measures to implement them.
The representatives of the control objects present at the meeting expressed their readiness to further implement the recommendations. And the Accounting Chamber will continue to monitor this process and inform the public about its results.
